{"id":2397,"date":"2025-08-14T14:09:43","date_gmt":"2025-08-14T13:09:43","guid":{"rendered":"https:\/\/i-veo.com\/heriter-dune-propriete-en-espagne-i-veo-real-estate\/"},"modified":"2025-08-26T08:08:02","modified_gmt":"2025-08-26T07:08:02","slug":"heriter-dune-propriete-en-espagne-i-veo-real-estate","status":"publish","type":"post","link":"https:\/\/i-veo.com\/fr\/heriter-dune-propriete-en-espagne-i-veo-real-estate\/","title":{"rendered":"H\u00e9riter d&rsquo;une propri\u00e9t\u00e9 en Espagne &#8211; I-VEO Real Estate"},"content":{"rendered":"\n<p><strong>(A) L&rsquo;ACTIF<\/strong><\/p>\n\n<ol class=\"wp-block-list\"><\/ol>\n\n<p>Sans entrer dans les d\u00e9tails du droit successoral r\u00e9gi par le livre III du code civil, nous nous int\u00e9ressons \u00e0 ce qui se passe lorsqu&rsquo;un bien est h\u00e9rit\u00e9 en Espagne.<\/p>\n\n<p>Tout d&rsquo;abord, il convient de distinguer le partage et l&rsquo;acceptation d&rsquo;un h\u00e9ritage :<\/p>\n\n<p>&#8211; L&rsquo;ACCEPTATION D&rsquo;UN H\u00c9RITAGE est un acte libre et volontaire par lequel une personne appel\u00e9e \u00e0 h\u00e9riter exprime sa volont\u00e9 d&rsquo;accepter un h\u00e9ritage.<\/p>\n\n<p>&#8211; LA CONCESSION D&rsquo;UN H\u00c9RITAGE est l&rsquo;acte par lequel les h\u00e9ritiers qui ont accept\u00e9 l&rsquo;h\u00e9ritage se partagent les biens en en acqu\u00e9rant la propri\u00e9t\u00e9.<\/p>\n\n<p>Si la question est claire et facile \u00e0 r\u00e9partir, les taxes correspondantes sont r\u00e9gl\u00e9es en Espagne et les modifications sont apport\u00e9es au registre foncier d&rsquo;un bien immobilier.<\/p>\n\n<p><strong>(B) LA VENTE D&rsquo;UN BIEN EN COPROPRI\u00c9T\u00c9<\/strong><\/p>\n\n<ol class=\"wp-block-list\"><\/ol>\n\n<p>Si un bien indivisible est h\u00e9rit\u00e9 par plusieurs h\u00e9ritiers, il n&rsquo;est pas rare que des conflits surgissent lors du partage des biens.<\/p>\n\n<p>S&rsquo;il y a de l&rsquo;argent ou d&rsquo;autres actifs, une compensation peut \u00eatre demand\u00e9e pour le transfert de propri\u00e9t\u00e9. Par ailleurs, pour vendre un bien \u00e0 plusieurs propri\u00e9taires, le consentement de tous est n\u00e9cessaire, faute de quoi la vente est valable. <\/p>\n\n<p>Ainsi, un bien ne peut \u00eatre vendu si l&rsquo;un des h\u00e9ritiers n&rsquo;est pas d&rsquo;accord.<\/p>\n\n<p>Si la copropri\u00e9t\u00e9 du bien ne peut \u00eatre \u00e9vit\u00e9e et que l&rsquo;un des h\u00e9ritiers souhaite vendre le bien, il peut proc\u00e9der comme suit :<\/p>\n\n<p>&#8211; Vendre leur part du bien aux autres h\u00e9ritiers ou \u00e0 des tiers. Les autres h\u00e9ritiers ont un privil\u00e8ge sur cette part indivise en payant le prix de vente. Si vous souhaitez plus d&rsquo;informations sur le sujet, nous vous les pr\u00e9senterons dans un autre article sur les droits de pr\u00e9emption.  <\/p>\n\n<p>&#8211; Tous les h\u00e9ritiers sont d&rsquo;accord pour qu&rsquo;un m\u00e9diateur soit consult\u00e9 avant la proc\u00e9dure judiciaire afin de trouver une solution appropri\u00e9e pour tous les int\u00e9r\u00eats.<\/p>\n\n<p>&#8211; Si les h\u00e9ritiers ne sont pas d&rsquo;accord, le processus judiciaire est termin\u00e9 et l&rsquo;extinction de la copropri\u00e9t\u00e9 de l&rsquo;h\u00e9ritage et la vente aux ench\u00e8res publiques du bien peuvent \u00eatre demand\u00e9es conform\u00e9ment \u00e0 la loi 15\/2015. Une \u00e9valuation du bien est demand\u00e9e, puis il est vendu aux ench\u00e8res. <\/p>\n\n<p>Les autres copropri\u00e9taires peuvent participer \u00e0 la vente aux ench\u00e8res et faire des offres. L&rsquo;inconv\u00e9nient est que si le bien est mis aux ench\u00e8res ensemble, le prix d&rsquo;adjudication peut \u00eatre inf\u00e9rieur au prix du march\u00e9. <\/p>\n\n<p>En r\u00e9sum\u00e9, on peut dire que dans ces cas de succession, un accord est toujours conclu entre les h\u00e9ritiers afin d&rsquo;\u00e9viter les mauvais moments et les frais (avocat, \u00e9valuateur, proc\u00e9dure judiciaire,&#8230;). En outre, il convient de noter que la vente d&rsquo;un bien aux ench\u00e8res publiques se fait g\u00e9n\u00e9ralement \u00e0 un prix inf\u00e9rieur \u00e0 celui qui serait vendu sur le march\u00e9. <\/p>\n\n<p><strong>C) SUCCESSIONS DE NON-R\u00c9SIDENTS EN ESPAGNE<\/strong><\/p>\n\n<ol class=\"wp-block-list\"><\/ol>\n\n<p>Si un bien immobilier est h\u00e9rit\u00e9 en Espagne et que l&rsquo;h\u00e9ritier ne r\u00e9side pas en Espagne, ces h\u00e9ritages sont r\u00e9gis par le r\u00e8glement europ\u00e9en 650\/2012 sur les successions et la cr\u00e9ation du certificat successoral europ\u00e9en. Un \u00e9tranger non-r\u00e9sident qui h\u00e9rite d&rsquo;une propri\u00e9t\u00e9 en Espagne doit savoir qu&rsquo;il devra payer l&rsquo;imp\u00f4t sur les successions en Espagne et l&rsquo;imp\u00f4t local sur les plus-values.
